1. Acceptance of These Terms

These Terms of Service ("Terms") apply to your use of Q Edu, including the Android app, web app, learning content, AI features, subscriptions, e-books, and related services. By using the app or service, you agree to these Terms. If you do not agree, do not use the service.

2. Service Description

Q Edu provides language-learning features such as speaking practice, listening practice, conversation exercises, translation, learning feedback, video-based learning, AI-generated learning support, and e-book access. Some features may work without sign-in, while account sync, paid access, and purchase restoration may require Google Sign-In or Google Play services.

3. Eligibility and Accounts

The app is intended for users aged 13 and older. K-12 labels in the app describe lesson difficulty levels and do not mean the service is directed to children under 13. You are responsible for keeping your account credentials secure and for activity under your account. If you use Google Sign-In, your Google account is also governed by Google's terms and policies.

4. Learning Content and AI Outputs

AI features may generate conversation replies, translations, word explanations, practice questions, and speaking feedback. AI output can be inaccurate, incomplete, or unsuitable for a particular purpose. You should review important information before relying on it. The service is for education and practice only and does not provide legal, medical, financial, or professional advice.

5. On-Device AI and Server AI

Some AI features may run on an on-device model. When an on-device model is used, the AI processing for that feature runs locally on your device. Model downloads may require Wi-Fi, storage space, and device resources. If server AI features are used, your input may be sent to a server, an OpenAI API, or an OpenAI-compatible AI provider to generate a response. More information is available in the Privacy Policy.

6. User Input and Acceptable Use

You are responsible for the text, speech, prompts, and other input you provide. Do not use the service to create, upload, request, or distribute unlawful, harmful, abusive, infringing, deceptive, or security-breaking content. Do not attempt to bypass access controls, payment checks, rate limits, or technical protections. These Terms do not limit rights granted by applicable open-source licenses for open-source components used in the app.

7. Purchases, Subscriptions, and E-Books

Premium subscriptions and e-book purchases are processed through Google Play Billing. Google processes payment method details, and Google Play terms may apply. Prices, renewal periods, trial or launch offers, taxes, and availability may vary by country, account, and platform.

8. Third-Party Services

The service may rely on third-party services such as Google Sign-In, Google Play services, Google Play Billing, AdMob, YouTube, OpenAI API, OpenAI-compatible AI providers, and Supabase. Your use of those services may be subject to their own terms and policies, including the Google Play Terms of Service, YouTube Terms of Service, YouTube API Services Terms of Service, and OpenAI terms and policies.

9. Intellectual Property

The app, learning materials, e-books, user interface, lesson structure, and related content are owned by the developer or licensors, except where open-source or third-party licenses apply. You may use the service and purchased content for personal learning only. You may not copy, modify, distribute, sell, or create derivative commercial products from app content unless you have permission or a license that allows it.

10. Your Content

You retain rights to your own learning input, prompts, and speech content. You grant us a limited permission to process that content only as needed to provide app features, sync progress, verify purchases, maintain the service, improve reliability, and comply with law and policy, as described in the Privacy Policy.

11. Ads and Free Features

The free version may include ads and usage limits for some AI features. Premium users may have ads removed where supported. We may change free limits, premium benefits, supported models, or available features to maintain service quality, comply with policy, or improve the app.

12. Service Availability and Changes

We aim to keep the service available, but features may be interrupted, delayed, changed, or discontinued due to maintenance, device limits, network conditions, third-party services, policy requirements, or technical issues. We are not responsible for outages or changes caused by third-party platforms or services.

13. Account Suspension or Termination

We may restrict or terminate access if you violate these Terms, abuse the service, attempt fraud, infringe rights, interfere with service security, or create legal or operational risk. You may stop using the service at any time and request account or data deletion as described in the Privacy Policy.

14. Disclaimers and Limitation of Liability

To the maximum extent permitted by applicable law, the service is provided "as is" and "as available" without warranties of uninterrupted operation, accuracy, fitness for a particular purpose, or error-free AI output. To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of data, learning progress, profits, or business opportunities.

15. Consumer Rights

Nothing in these Terms limits rights that cannot be waived under applicable consumer protection law. If a local law gives you mandatory rights for digital content, subscriptions, refunds, cancellation, or data protection, those rights continue to apply.

16. Changes to These Terms

We may update these Terms when app features, paid products, third-party services, policies, or legal requirements change. The latest version will be posted at this URL. Continued use of the service after changes means you accept the updated Terms.

18. AI Provider and Open Source Notices

OpenAI API: When OpenAI API is used for server AI features, your prompts, learning text, conversation content, translation requests, evaluation requests, and AI outputs may be sent to OpenAI to generate a response. OpenAI's applicable services agreement, usage policies, and data controls may apply to API processing.
